Inscape, Inc., a subsidiary of VIZIO, Inc. (“Inscape,” “we,” or “us”) is committed to respecting and protecting your privacy. Please read this Privacy Policy carefully as it is meant to help you understand our practices, including your choices, regarding the collection, use and disclosure of certain information, including your personal information in connection with your use of the Inscape website (“Site”).

 

THIS SITE IS DIRECTED TO USERS IN THE UNITED STATES ONLY. INSCAPE PRODUCTS AND SERVICES ARE CURRENTLY NOT AVAILABLE TO USERS OUTSIDE THE UNITED STATES.

 

THE SITE AND USE OF ANY INSCAPE PRODUCTS OR SERVICES ARE NOT INTENDED FOR ANYONE UNDER THE AGE OF 18.

 

This Privacy Policy does not apply to the collection, processing, storage, transfer, and/or disposal of information collected in connection with VIZIO, Inc (“VIZIO”) products and services.     I.               COLLECTION OF INFORMATION

 

Information You Provide to Us

Inscape collects certain information that you provide to us – for example, when you fill out the Contact Us form – we may collect your name, address, phone number, or the contents of a message or attachments that you may send to us.

 

Information We Collect Automatically

Inscape uses cookies and similar technologies to automatically collect information from your device about your use of the Site and to provide additional functionality.

 

Cookies. By using cookies, we can measure how you have interacted with the Site. Our third-party partners also use cookies to measure audience engagement. This means that we and our partners may collect your browser type, unique identifiers, geolocation, web pages visited, duration of visit, content viewed, advertisements viewed, and other click-stream data/ We and our third-party partners may use cookies to serve ads about our products when they visit other sites. Your browser contains features to help you manage, remove, or prevent placement of cookies. Pixel tags. Pixel tags (also known as web beacons and clear GIFs) may be used to, among other things, measure the success of Inscape’s marketing campaigns and compile statistics about usage of the products/services and response rates (for example, recording how many emails in a campaign were opened). Pixel tags may also be used in connection with our third-party partners to collect similar types of information as outlined in the above section on cookies.

 

Flash LSOs. Inscape may use Flash LSOs and other technologies to, among other things, collect and store information about your use of the products/services. If you do not want Flash LSOs stored on your device, you can adjust the settings of your Flash player to block Flash LSO storage using the tools contained in the Website Storage Settings Panel. You can also follow the instructions (which may explain, for example, how do delete existing Flash LSOs, how to prevent Flash LSOs from being placed on your device without your being asked, and how to block Flash LSOs that are not being delivered by the operator of the page you are on at the time). Please note that setting the Flash Player to restrict or limit acceptance of Flash LSOs may reduce or impede the functionality of some Flash applications.

 

Site and Product Analytics. Inscape may use third party analytics companies, such as Adobe Analytics and/or Google Analytics, which use cookies and similar technologies to collect and analytics information about use of the products/services and report on activities and trends.     II.              USE OF INFORMATION

 

Your information collected by Inscape is for use by Inscape and others on Inscape’s behalf for the following purposes:

 

To communicate with you. Inscape will use your information to respond to you when you contact us and to communicate with you about your Inscape products/services.

 

To market and promote Inscape products and services to you. We may use your information, such as email address or telephone number to market and promote information about Inscape products, features, events, and/or services that may be of interest to you.

 

To provide for the integrity and availability of the Site. We automatically collect information about your interactions with the Site for security purposes, to facilitate navigation, and to display information more effectively on the Site.

 

To improve Inscape products and services. We may use your information to improve and enhance the Site, products, and services, or to develop new products, services, features, and functionality.

 

Security and Fraud Prevention. We may use your information as necessary to protect, investigate, and deter against fraudulent, unauthorized, infringing, or illegal activity.

 

To support legal functions. We may compile metrics about the requests Inscape receives to access, delete, or correct information or to limit the handling of information.

 

Applicable law. Inscape may use your information as required by applicable law, regulations, or other legal processes.

 

    III.            SHARING OF INFORMATION

 

Sharing with Corporate Affiliates. Information collected from or about you may be accessed or shared with Inscape’s corporate affiliates such as VIZIO to operate the Site and to perform data analytics.

 

Sharing with Third Parties. Inscape uses third parties, including contractors and services providers, to provide services for us and to help with our operations, which may require that they access and use your information. For example, see above for Site and Product Analytics.

 

Other circumstances for disclosing information. Inscape will disclose information as required by law, or if any of the following applies in Inscape’s judgment:

  • it is necessary to respond to lawful government requests or legal process (e.g. a court order, a search warrant, or subpoena);
  • the information is relevant to a crime that has been or is being committed;
  • an emergency exists that poses a threat to your safety or the safety of another person; or
  • it is necessary to protect the rights or property of Inscape or our employees.
 

    IV.            CONSUMER CONTROLS FOR HANDLING OF INFORMATION

 

Controlling your email marketing choices. You may choose to stop receiving marketing emails at any time by following the instructions in those messages (often it will be a notice or a link at the bottom of the message).

 

Access, Removal or Correction of your information. If you desire to access, remove, or correct your information that you have provided or that Inscape has collected about you, please fill our Privacy Web Form or call (855) 472-8817. If you request removal of your personal information, you acknowledge that residual information may continue to reside in Inscape’s records and archives, but Inscape will not use that information going forward for commercial purposes. Inscape reserves the rights to maintain your information if required by applicable law. Inscape reserves the rights to refuse to process information removal requests that are impractical or jeopardize the privacy of others.

 

Your choices and Opting-Out.

    V.              DATA RETENTION

 

Inscape will retain information for as long as needed or permitted in light of the purpose(s) for which it was obtained, or for a period of time specifically required or allowed by applicable laws or regulations.

 

    VI.            DATA SECURITY

 

Inscape uses reasonable and appropriate measures designed and maintained to safeguard information within Inscape’s organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. To help protect your information, we recommend that consumers follow best practices for internet activities, including proactive password management and router security protocols.

 

    VII.           INTERNATIONAL DATA

 

The Site is directed to visitors and end users in the United States only. Inscape does not solicit or intentionally collect information from individuals or entities located outside of the United States.  If you are located outside of the United States, please do not provide your information to Inscape.

 

    VIII.         HANDLING OF MINOR’S DATA.

 

Inscape does not knowingly collect information from children under the age of 13 for any purpose. However, if Inscape learns that it has collected information of a child under age 13, Inscape will attempt to delete that information as soon as possible and take any other measures required under applicable law.

INSCAPE PRIVACY POLICY ADDENDUM FOR RESIDENTS OF U.S. STATES WITH SPECIFIC PRIVACY LAWS

 

This Inscape Privacy Policy Addendum for Residents of the U.S (United States) States with Specific Privacy Laws (“Addendum”) applies to consumers who reside in states that have adopted consumer privacy laws and supplements the Inscape Privacy Policy. This Addendum is in addition to and supplements the Inscape Privacy Policy.

 

Each state’s privacy law is different. This Addendum sets forth certain privacy rights for each respective state with privacy laws in effect as of the effective date of the Inscape Privacy Policy.

HOW WE COLLECT, USE AND SHARE PERSONAL INFORMATION

Below is a summary describing the personal information Inscape collects about you, the reason we collect your personal information, and how we share your personal information with others. Please see the Inscape Privacy Policy for further detail about how we collect, process, or share personal information about you.

i.                Categories of Information. When you visit the Site or interact with Inscape, we or our service providers may collect “personal information,” or “personal data” as may be defined in state privacy regulations. We collect this personal information directly from you with you communicate with us, indirectly from you through cookies and related technologies, and from third-party service providers, data aggregators, and marketing. Inscape, or our service providers, may collect the following categories of personal information for business or commercial purposes.

a.    “Identifiers” including your name, email address, phone number, and mailing address;

b.     “Commercial Information” such as information about the Inscape products or services you request or purchase;

c.      “Internet or other Electronic Network Activity” including search and browsing history, information collected from cookies and similar technologies, and analytics data;

d.     “Geolocation” including IP (Internet Protocol) addresses;

e.     “Inferences” derived from your personal information.

ii.              Use of Information. Inscape uses the categories of information identified in Section A(i) for the following business and commercial purposes:

a.     to fulfill requests,

b.     to communicate with you including about promotions and offers according to your choices;

c.      market and promote Inscape products and services to you;

d.     provide for the integrity and availability of our Site;

e.     ensure security and prevent fraud;

f.      to operate and improve the Site, personalize your experience, perform analytics, to deliver ads and promotions about our products and services, to assess your interest in our products and services, and to conduct customer research and surveys;

g.     to derive zip-code level information to better understand how the Site is being used; and

h.     to derive insights about Inscape customers and their preferences to improve Inscape products and services.

iii.             Selling Information. Inscape does not sell your personal data to any third parties.

iv.             Sharing of Information. Inscape has not shared, orally, in writing, or by electronic or other means, any categories of personal data to any third party for cross-context behavioral advertising. Inscape does share the following categories of personal data to its service providers as follows:

a.     “Identifiers” to deliver Inscape products and services and features, to facilitate customer support interactions and responses to requests you make, to market you about our products and services, and to process purchases (if applicable);

b.     “Commercial Information” to process customer requests for us to deliver product information to you, to process transactions or to fulfill customer orders or requests;

c.      “Internet or other Electronic Network Activity” for analytics, advertising, and other services for Inscape;

d.     “Geolocation” data to assist with the functionality of the Site.

In addition to the disclosure of the of categories of personal data above, please note that Inscape will disclose information as required by law, or to any of the following third parties in the following circumstances:

e.     Courts and Other Third Parties in Response to Legal Requests – if the information is necessary to respond to lawful government requests or legal processes (e.g., a court order, search warrant, or subpoena);

f.      Law Enforcement and Third-Party Partners – if the information is relevant to a crime that has been or is being committed; or if an emergency exists that poses a threat to your safety or the safety of another person; or it is necessary to protect the rights or property of Inscape or Inscape’s employees;

g.     Acquiring Company or Companies – if the ownership of Inscape or an affiliate or their respective assets change as a result of a merger, acquisition, sale of assets, or in the unlikely event of a bankruptcy, information may be transferred to another company. The acquiring company may only use the information as set forth in the Policy and this Addendum.

YOUR CCPA PRIVACY RIGHTS

 

The CCPA provides California residents with certain privacy rights regarding their personal information. These privacy rights are available to consumers, employees, former employees, job applicants and business to business partners of Inscape. These privacy rights are not absolute and certain exceptions apply under the CCPA.

 

Right to Know/Access – You have the right to know the categories and specific pieces of personal   information we have collected about you in the previous 12 months. 

 

Right to Correct – You have the right to request we correct inaccuracies in personal information we have collected specifically about you.

 

Right to Deletion – You have the right to request that we delete any personal information we have collected about you. 

 

Right to Opt-out of the Sale or Sharing of Information – You have the right to opt-out of the sale or sharing of personal information we have collected about you.  (Note: Inscape does not sell your personal information collected or obtained by you when you visit the Site, nor does Inscape share your personal information for cross-context behavioral advertising.)

 

Right to Limit Sensitive Data – You have a right to limit our use and disclosure of sensitive personal information (as defined by the CCPA) we may collect from our about you. (Note: Inscape does not collect sensitive personal information from or about you when you visit the Site.)

 

Right to Non-Discrimination – You have the right to not receive discriminatory treatment for exercising any of your CCPA rights. VIZIO will not treat you differently for exercising any of the rights described above.

We will use the information you provide to process your access, correction, or deletion request, verify your identity, maintain a record of your request, and our response. If you request that we delete your personal information, you acknowledge that residual information may continue to reside in Inscape’s records and archives, but Inscape will not use that information for commercial purposes going forward.

 

Authorized Agents. You may also authorize an individual (your “agent”) to submit a request on your behalf. If you use an agent to submit a request to opt-out on your behalf, we may require you to verify your identity directly with us, and directly confirm with us that you provided the authorized agent permission to submit the request. Subject to California law, we will not act upon a request until your identity has been sufficiently verified. 

 

Response Timing. We process your access, correction, and deletion requests as soon as reasonably practicable and in compliance with any applicable legal requirements. Please note that it may take additional time to verify and fulfill requests submitted by agents.

 

CALIFORNIA JOB APPLICANTS

 

Note that Inscape collects certain information about you in connection with your application for employment with Inscape. This section details the personal information Inscape receives about you, how we process it, and the rights and obligations you may have in relation to your personal information. 

 

INFORMATION WE COLLECT ABOUT YOU:  

a.    Identifiers and Demographic Data.  This includes data such as title, full name, contact details, such as home and work address, phone number(s), email address(es), and your geographic preferences for the location of employment. 

b.    Sensitive data. This includes data such as social security numbers collected for application-related purposes.   

c.    Professional or employment-related information. This includes information such as work history and prior employment information. 

d.    Non-public education information. This is information related to your academic credentials such as what school you went to, what your GPA was, what activities or sports you did in school, or other data on your school transcripts. 

 

Inscape collects this information about you from the following sources: 1) directly from you; 2) prior employers, references, recruiters, job-related social media platforms; 3) third-party sources of demographic information; and 4) third-party companies, such as background check companies, and drug testing facilities. 

 

HOW WE USE THE INFORMATION WE COLLECT ABOUT YOU:

 

Inscape will process your personal information in connection with your employment application and, if you are hired, for employment-related purposes, including: 

a.    Recruitment, including, verifying eligibility to work, obtaining professional and personal references and screening of educational and professional background data prior to and during the course of the interviewing process and employment, including carrying out criminal record checks (where permitted under applicable law). 

b.    Assessing your suitability for employment with Inscape and its affiliates. 

c.    Conducting background investigations. 

d.    Verifying certain information about you. 

e.    Conducting application and employment-related statistical analyses. 

f.    Communicating with you during the hiring process and during employment regarding your employment and employee benefits. 

g.    Complying with all relevant legal, regulatory, and administrative obligations and responsibilities of VIZIO. 

h.    Conducting exit surveys. 

 

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice. 

 

HOW INSCAPE SHARES AND/OR SELLS THE INFORMATION WE COLLECT ABOUT YOU:  

 

Your information will not be shared with unaffiliated third parties for purposes not related to your application and/or employment. Inscape will transfer your personal information to our third-party service providers for purposes related to your application for employment, and, if you are hired, for employment-related purposes, including to vendors who help us perform the following services for us:

b.    Background and criminal history checks.

We do not and will not sell any of your personal information. By providing your personal information, you acknowledge and consent to its collection, use, retention and sharing for the stated purposes.

Right to Access – You have the right to request access to all the specific pieces of Personal Data we have collected and maintained about you including final Profiling decisions, inferences, derivative data, marketing profiles and other Personal Data we have created which can be linked or reasonably linked to you.  

 

Right to Correct – You have the right to request we correct inaccuracies in your Personal Data we have collected specifically about you.  

 

Right to Delete – You have the right to request that we delete any Personal Data we have collected about you.  

 

Right to Opt-Out – You have the rights to opt out of our processing your Personal Data for purposes of (i) targeted advertising, (ii) the sale of Personal Data, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

Authorized Agents - You may also authorize an individual (your “agent”) to exercise your right to opt-out. Pursuant to the CPA, we may not act upon your request until your identity and the agent’s authority to act on your behalf has been verified.  

 

Response Timing – We will process your access, correction, and deletion requests as soon as reasonably practicable and in compliance with the CPA.  

 

Right to Appeal – If we decline to act on your request, we will provide you with a written explanation for our decision and will provide you with instructions on how you can exercise your right to appeal.  


SECTION 3: CONNECTICUT RESIDENTS

 

In addition to the “How We Collect, Use and Share Personal Information” above, this Section 3 applies to Connecticut residents and describes your rights and choices with respect to the processing of your personal data under the Connecticut Data Privacy Act (“CTDPA”). “Personal Data” is defined by the CTDPA as “information that is linked or reasonably linkable to an identified or identifiable individual” and does not include de-identified data or publicly available information. Note that the CTDPA does not apply to Personal Data collected about you during the course of your employee at Inscape (if applicable) or during your job application process of applying for employment at Inscape.

The Utah Consumer Privacy Act (“UCPA”) provides Utah residents certain privacy rights for their personal data collected by businesses. “Personal data” is defined by the UCPA as “information that is linked or reasonably linkable to an identified individual or identifiable individual” and does not include de-identified data or publicly available information. These privacy rights are not absolute and certain exceptions apply under the UCPA. To exercise any of these rights described below, see “Exercising Your UCPA Rights” section. Please note that these privacy rights do not apply to Personal Data collected by VIZIO during your employment at VIZIO or during the job application process.   

 

Right to Know and Access – You have the right to confirm whether we process your Personal Data and to access such personal data.  

 

Right to Delete – You have the request to request we delete Personal Data we have collected by or obtained about you.  

 

Right to Opt-Out – You have the right to opt out of our processing your Personal Data for purposes of (i) targeted advertising, or (ii) the sale of Personal Data.

This Section 5 applies to Virginia residents and describes your privacy rights and choices with respect to the processing of your personal data under the Virginia Consumer Data Protection Act (“VCDPA”). “Personal Data” is defined by the VCDPA as “any information that is linked or reasonably linkable to a Virgina resident.”  Please note that these privacy rights do not apply to Personal Data collected by us during your employment at Inscape or during the job application process.

Right to Correct – You have the right to request we correct inaccuracies in specific Personal Data we have collected about you.

 

Right to Deletion – You have the right to request that we delete any Personal Data provided by or collected about you.

Right to Opt-out - You have the right to opt-out of Inscape’s processing of your Personal Data for purposes of (i) targeted advertising, (ii) the sale of Personal Data, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.  (Note: When you visit the Site, Inscape does not use any personal data collected or obtained about you for (i), (ii), or (iii).)

Process for Appeal.  Inscape may decline to act on your access, correction, or deletion request. In such cases, Inscape will notify you that it has declined to take any action and the reason for such decision. Inscape will provide you with this notification as soon as reasonably practicable and in compliance with any applicable legal requirements. If Inscape declines your request, the process to appeal will be provided to you.
